Contextually, reference needs to be made, to the resolution passed by the Bombay Bar Association on 1.3.1995 by a majority of 185 out of 207 permanent members, demanding the resignation of Justice A.M. Bhattacharjee, the then Chief Justice of Bombay High Court. A writ petition came to be filed in this Court, seeking an appropriate writ, order or direction to restrain the Bar Council of Maharashtra and Goa, the Bombay Bar Association, and the Advocates' Association of Western India, from coercing Justice A.M. Bhattacharjee from resigning the office held by him. The petitioner in the above case, had also made a prayer, that the allegations levelled against Justice A.M. Bhattacharjee be required to be investigated by the Central Bureau of Investigation, and if the same were found to be true, a direction be issued to the Speaker of the Lok Sabha, to initiate action for the removal of Justice A.M. Bhattacharjee, under Article 124 read with Article 218 of the Constitution of India, and the Judges (Inquiry) Act, 1968.
