37. Further, the decisions relied upon by the respondents do not advance their case for the following reasons:
i. In Haffkine Bio-Pharmaceutical Corpn. Ltd. (supra 7), the Hon'ble Supreme Court interfered with the tender process due to lack of transparency, particularly the failure to open technical bids in the presence of bidders' representatives in violation of guidelines; however, the said decision is clearly distinguishable, as the present tender was conducted entirely on the Government e-Marketplace (GeM) portal, ensuring a transparent, electronic and tamper-proof process with all bids and evaluations digitally recorded. There is neither any allegation nor finding of procedural irregularity or lack of transparency, and the evaluation was carried out strictly on the basis of documents uploaded within time; the respondent No.1's failure to upload requisite proof cannot be attributed to the appellant.
