% 05.08.2025 CM APPL. 47536/2025 By way of the present application filed under section 151 of the Code of Civil Procedure 1908, respondent No.2/applicant seeks condonation of 69 days' delay in filing its counter-affidavit.

2. Vide order dated 29.07.2025 this court has observed that despite the last opportunity having been granted by order dated 21.04.2025, respondent No.2 had not filed its counter affidavit. In that backdrop, a further last opportunity was granted to respondent No.2 to file its counter affidavit within 02 weeks of 29.07.2025.

3. Be that as it may, in view of the prayer made, it is not considered necessary to issue notice on this application.

6. The Registry is directed to take the counter-affidavit filed by respondent No.2 on record.

7. A copy of the counter-affidavit is stated to have been received by learned counsel for the other parties.

8. The application stands disposed-of.
