The case of the prosecution in a nutshell is that on 11.07.2013, a wireless message was received from SHO Police Station Kotwali, Faridkot that Mandeep Kaur daughter of Shamsher Singh, resident of village Daya Kalan has been admitted in Government Hospital, Faridkot, due to acid injuries. On this DSP Jaswinder Singh along with ASI Gulzar Singh and other police personnel collected Ruqa from P.S. Kotwali, Faridkot and reached Shri Guru Gobind Singh Medical College, Faridkot and recorded the statement of Shamsher Singh, father of Mandeep Kaur. He stated that his daughter Mandeep Kaur was married with Harinder Singh about two years back. For the last one year, his daughter had a dispute with her husband. A divorce petition was pending before the Learned Sessions Judge, Moga. He along with his daughter was going to the Court on their Bajaj Chetak Scooter bearing No.PB-25B-3859 to attend the hearing in the said case. At about 9:30 a.m. when they reached near Gurukul School ahead of village Kokari Kalan and before sem nallah, then four persons on two motorcycles came from their back side from Kokari Kalan. On one motorcycle his son-in-law Harinder Singh was sitting on the pillion seat. They took one motorcycle to the right side of the scooter of the complainant. The other motorcycle on which his 3 of 41 CRA-D-1001-DB-2016(O&M) -4- son-in-law Harinder Singh was the pillion rider was taken to the left side of the scooter of the complainant. His son-in-law had a jug full of acid. He threw the acid on him and his daughter with an intention to kill them. The complainant and his daughter tried to save themselves, but accused Harinder Singh threw more acid on them. They were badly burnt. Both fell down on the road along with the scooter. His son-in-law Harinder Singh along with his companions ran away from the spot on the motorcycles. Some unknown person got them admitted in Civil Hospital, Moga for medical treatment, from where they were referred to Shri Guru Gobind Singh Medical College, Faridkot. He stated that Karamjit Kaur mother, Sukhmander Singh uncle and Sukhminder Kaur, wife of uncle of Harinder Singh used to threaten them that if his daughter did not remain with them and withdraw the cases, they would be burnt and acid would be thrown on them. On the basis of this statement, FIR was registered. Site plan was prepared. Statements of witnesses were recorded. Sand mixed with acid was taken into police possession from the spot. Accused were arrested. Accused Harinder Singh and Jagjit Singh suffered disclosure statement leading to recovery of a jug and a can of plastic. On 16.07.2013 statement of Mandeep Kaur was recorded, wherein, she implicated her father-in-law Paramjit Singh, mother-in-law Karamjit Kaur, uncle-in-law Sukhmander Singh and aunt-in-law Sukhminder Kaur about raising dowry demands. Offences under Sections 406 and 498-A IPC were added. After completing the investigation, challan was filed.
12. He further deposed that Sandeep Singh, the son of the complainant, was also following them. He reached at the spot and got them admitted in Civil Hospital, Moga, from where the doctor referred them to Guru Gobind Singh Medical College and Hospital, Faridkot due to the seriousness of the injuries. His statement was recorded at Guru Gobind Singh Medical College and Hospital, Faridkot on the same day. He identified the accused in Court. He stated that he did not want to say anything more.
20. She further deposed that on 11.07.2013 she and her father were coming to Court to attend the divorce petition at Moga. When they crossed village Kokari Kalan, behind Gurukul School, then two bikes came there, one from their left side and the second from their right side. The motorcycle to their right was driven by Deepinder Singh and Parwan Singh was pillion rider. They were friends of Harinder Singh. The motorcycle/bike which was to their left was being driven by one Jagga and Harinder Singh was sitting behind him. The persons who were riding the motorcycle on the right side stopped them. Harinder Singh had a jug filled with acid. He threw the acid on her face and body. He also threw the acid on the body of her father. She and her father suffered acid burn injuries. Her left eye has been totally damaged. She and her father fell on the ground. Her brother Sandeep Singh was following them on bike and witnessed the entire occurrence. He took both of them to Civil Hospital, Moga. After giving first aid, they were referred by the doctor to Medical College, Faridkot. From Medical College, Faridkot, they were further referred to DMC&H, Ludhiana in view of their serious 11 of 41 CRA-D-1001-DB-2016(O&M) -12- condition. She remained in burn ICU ward for about 4-5 months. She stated that she was still under treatment and had not regained her proper eye sight. She had undergone many surgeries. She deposed that the acid had been thrown by Harinder Singh in conspiracy with all the accused. She identified the accused in Court. She stated that copy of application given to Police Station, Mehna was Mark-C. She had got recorded her statement before the police on 16.07.2013 at DMC, Ludhiana. The same bears her thumb impression and was Mark-D. She proved her photograph before the incident Ex.P1 and her photographs and that of her father after the occurrence Ex.P2 to Ex.P15.
24. PW-3 Constable Dilraj Singh deposed that on 11.07.2013 he handed over the special reports of the case to Mrs.Sanjeeta, the then CJM/Duty Magistrate, Moga and other relevant officers.
25. PW-4 ASI Gulzar Singh stated that on 11.07.2013, he was posted at P.S. Ajitwal. On that date, he received information that some persons had thrown acid on Shamsher Singh and Mandeep Kaur and they are admitted in Civil Hospital Moga. The information was received orally. He informed DSP Jaswinder Singh Gharu, DSP, Sub Division Nihal Singh Wala. They went to Civil Hospital, Moga. On learning that they had been referred to Shri Guru Gobind Singh Medical 14 of 41 CRA-D-1001-DB-2016(O&M) -15- College and Hospital, Faridkot, he along with police officials went to the hospital at Faridkot where DSP Jaswinder Singh Gharu recorded the statement of Shamsher Singh Ex.PA. Shamsher Singh appended his signatures at Point-A. The DSP made his endorsement Ex.PA/1. DSP sent ruqa through constable Sukhjinder Singh to get the FIR registered and formal FIR Ex.PW3/A was registered by ASI Balbir Singh. Thereafter, he (PW4) along with other police officials went to the place of occurrence near Gurukul School in the area of village Kokari Kalan. He prepared rough site plan Ex.PW4/A. He took into possession the burnt clothes of Mandeep Kaur i.e. salwar and kameez vide Memo Ex.PW4/B. He also took into possession scooter PB-25-B-3859 Bajaj Chetak vide memo Ex.PW4/C. He also took into possession the plain earth and ash from the spot vide memo Ex.PW4/D. On return to the police station, he deposited the said articles with the MHC.
