This application is filed under Section 439 of the Code of Criminal Procedure in connection with First Information Report registered as I-C.R. No.150/2012 with Odhav Police Station, Ahmedabad for the offences punishable under Sections 307, 294(B) of the Indian Penal Code and under Sections 25(1)(b)(a) and 27 of the Arms Act.
Learned Counsel appearing for the applicant submits that the applicant herein is a retired Army man. It is submitted that a dispute arose about parking of vehicles in the common plot of the society and in the said scuffle, the applicant is alleged to have used a fireman. It is submitted that this firearm has already been seized by the police. However, considering the fact that no injuries have been caused to the applicant herein, it is submitted that the applicant may be enlarged on bail.
