Learned counsel for the applicant submits that the present applicant has been made accused only on the basis of memorandum of co-accused persons that the present applicant has introduced the contract killers, who are the main accused and committed murder of Mahendra Verma, that too at the instance of other co-accused namely Shikhar Chand Jain. He submits that there is no material available with the prosecution except the memorandum indicating that he was involved in such a crime and has introduced the contract killers to the financier Shikhar Chand Jain. He submits that the statement made by the co- accused persons on their memorandum is not admissible and therefore, the present applicant has been falsely implicated and is entitled to be released on bail.

Shri Pandey appearing for the objector has also opposed the bail application and submitted that the present applicant has past criminal antecedents and other co-accused persons are contract killers and if bail is granted to them, they would definitely influence the witnesses. He further submitted that still the complainant is receiving threats and a complaint in that regard has also been made by him to the police.
