Counsel for the petitioner submits that on principle the applicability of the 4th Pay Commission on Officers/Employees have been examined by the Division Bench of this court under the judgment - W.A. No.74/2003 dt.08.04.2011 and Special Leave to Appeal preferred by the State of Tripura has been dismissed. Although, the relief was confined by the Apex Court to the members of Tripura Jute Mill Officers Association and that appears to be the reason the employees have approached this court agitating the grievance by filing of a writ petition.

Counsel submits that apart from the technical objection which has been noticed by the Apex Court confining to the members of the Officers Association but the Division Bench examine on principle the grievance of the Officers/Employees and after the judgment of the Page - 2 of 2 Apex Court, the employees have approached this court by filing of a separate petitions with a grievance that after the principles laid down by the Division Bench of this court regarding applicability of 4th Pay Commission w.e.f. 01.01.1996 there appears no reason to have any disparity regarding applicability of 4th Pay Commission to the employees of Jute Mills from other Public Sector Undertakings and submits that based on the principles laid down by the Division Bench of this court, the employees are also entitled for applicability of the 4th Pay Commission w.e.f. 01.01.1996.

Counsel for the respondents wants time to examine. List the matter on 16.07.2018.
