3. After service of summons, the Written Statements were filed by the defendants. The defendant no.1 to 7, in their joint Written Statement, have stated that the plaintiffs and defendant no.8 are their tenants and that it is the defendant no.8, not defendant no.1 to 7, who had been raising illegal construction and that in the eviction suit filed by the defendant no.1 to 7 against the defendant no.8, he has given undertaking before the Court for not raising any illegal construction. They have further stated that the defendant no.8 has no right, title or interest in the shops in question as the said shops were let out by Sh. Laxman Singh and Sh. Nanhe Ram to the predecessors­in­interest of the plaintiffs and after their death, the right, title and interest in said shops has devolved upon the defendant no.1 to 7 who are now the owners/landlords of the said shops. ownership over the said property on the basis of five Sale Deeds. Without admitting the authenticity of the said Deeds, even if the title documents of appellant are presumed to be correct for a moment, even then he is not the exclusive owner of the entire said property. He has claimed ownership on the basis of 5 sale deeds. As per these documents, there were four predecessors­ in­title of the said property i.e. Zile Singh, Deshram, Bhima and Balram. After the death of Deshram, his 25% undivided share devolved upon his two sons Shamsher Singh and Rattan Singh and after the death of Rattan Singh, his 12.5% undivided share devolved upon his three sons namely Lalit Kumar, Kuldeep Singh and Partap Singh. After the death of Bhima, his 25% undivided share devolved upon his three sons namely Ramesh Chand, Vijay Singh and Raj Kumar. After the death of Balram, his 25% undivided share devolved upon his two sons namely Sukhbir Singh and Balbir Singh. Sukhbir Singh and Balbir Singh sold their respective 12.5% undivided share to appellant vide two registered Sale Deeds dated 26.04.2010. Shamsher Singh sold his 12.5% undivided share to appellant vide registered Sale Deed dated 30.04.2010. Ramesh Chand, Vijay Singh and Raj Kumar sold their joint 25% undivided share to appellant vide registered Sale Deed dated 18.06.2010.
