2. In this writ petition, it is projected that on 29.04.2016, the accused No.1 in Barpeta PS Case No.156/2016 had entered the house of the petitioner and poured acid on the petitioner and his parents. While on treatment, the father of the petitioner died on 30.04.2016 and the mother of the petitioner suffered grievous injuries, and later on she also expired on 03.07.2016. It is projected that by virtue of Notification dated 09.11.2016, issued by the Ministry of Home Affairs, Government of India, the State is also issued a Notification dated 21.12.2016 by which apart from Central compensation of Rs.1,00,000/-(Rupees One Lakh Only), the State also bears additional compensation of Rs.1,00,000/- (Rupees One Lakh Only) to the acid attack victim under the Prime Minister National Relief Fund. It is submitted that the application for compensation was submitted before the Deputy Commissioner, Barpeta, on 16.02.2018 but the compensation is not yet received by the petitioner who is presently 14 years of age and in this writ petition she is being represented by her elder sister.

3. Issue notice returnable on 25.01.2023.

4. Requisite extra copies of the writ petition be served on the learned DSGI and the Govt. Advocate in the course of the day.

5. Pendency of the writ petition shall not be a bar for the Deputy Commissioner, Barpeta (Respondent No.3) to examine the claim of the Page No.# 3/3 petitioner and the case record being Barpeta PS Case No.156/2016 under Section 457/326(A)/302/34 of the IPC and take an appropriate decision to release the compensation to the petitioner who is an acid attack victim.
