8.2 Reading the award in question, it clearly reflects that there is a clear application of mind on the part of learned Presiding Officer who found specifically that even seniority list has also not been maintained by the petitioner, no details have been provided to justify whether there is compliance of Rule 81 of the Gujarat Industrial (Dispute) Rules. Therefore, not only there is a violation of Section 25F of the ID Act, but also there is a clear violation of Section 25D of the Act as well as Rule 81 of the Rules. It was also noticed by learned Presiding Officer that even after discontinuance of respondent, new persons have been engaged which has clearly violated Section 25F, 25G and 25H of the I.D. Act. Keeping all these circumstances, it has been found that action of discontinuance is clearly in violation of Section 25F, 25G and 25H of the I.D. Act as well as Rule 81 has also been violated and, therefore, keeping in mind long length of service of 28 years and a salary of Rs.4500/ p.m. , a conclusion arrived at by learned Presiding Officer is to pay lumpsum compensation of Rs.2,50,000/ in substitution of reinstatement and backwages.
