03.02.2023 Learned counsel for the petitioner submits that he was never summoned in the matter, yet the court of Joint Financial Commissioner, Srinagar, while exercising the powers of Financial Commissioner (Rev)/Commissioner Agrarian Reforms J&K, Srinagar, has passed the impugned Order dated 3rd October, 2022, whereby it has been observed that the other party i.e., petitioner herein was summoned, but he did not choose to appear in the matter, therefore, the same was taken in ex-parte. Besides the learned counsel appearing on behalf of the petitioner vehemently argues that the Financial Commissioner, Revenue, has observed in the impugned order that the Parat Sarkar is not available and even on the Parat Patwar copy, no date has been mentioned and there is an attempt to mislead the authorities in arriving at the applicability of the law at the relevant point of attestation of the said mutation. Learned counsel also vehemently disputes the aforesaid observation and with a view to substantiate has referred to the Parat Patwar in which the date has been mentioned.
