This revision has been filed to set aside the impugned order passed by the learned District Munsif cum Judicial Magistrate, Rameswaram, made in Cr.MP.No.990 of 2020, dated 17.08.2020.

The petitioner claims to be the owner of the vehicle/ Yamaha FZs two wheeler bearing Registration No.TN-65-AE7948 which was seized by the respondent Police in Crime No.87 of 2020, under Sections 147, 148, 294(b) and 506 (ii) I.P.C. The petitioner filed a petition for return of the vehicle before the District Munsif cum Judicial Magistrate, Rameswaram,, in Cr.M.P.No.990 of 2020. The District Munsif cum Judicial Magistrate, Rameswaram, dismissed the petition on 17.08.2020. Against that order, the petitioner preferred this Revision.
5. Heard the learned counsel on either side and perused the materials available on record.
6. It is seen that the petitioner is the owner of the vehicle. There is no dispute regarding the ownership of the vehicle. If the vehicle is kept open, the value of the vehicle will be deteriorating day by day. Hence, this Court is inclined to allow the revision.
7. Accordingly, this Criminal Revision Case is allowed and the order order passed by the learned District Munsif cum Judicial Magistrate, Rameswaram, made in Cr.MP.No.990 of 2020, dated 17.08.2020, is set aside and the vehicle/ two wheeler is ordered to be returned to the petitioner for interim custody subject to the confiscation proceedings on the following conditions:-
(i) The petitioner shall deposit the original Registration Certificate of the vehicle before the District Munsif cum Judicial Magistrate, Rameswaram;

(ii)The petitioner shall deposit a sum of Rs.10,000/- (Rupees Ten Thousand only) to the credit of Crime No.87 of 2020 on the file of the learned District Munsif cum Judicial Magistrate, Rameswaram, within a period of four weeks from the date of receipt of a copy of this order along with a bond for a sum of Rs.50,000/- (Rupees Fifty Thousand only) with two sureties for a like sum;
