In England, it is now established that to decide whether a particular statutory corporation would be entitled to claim Crown privilege in litigation or whether it would be bound by a statute it is to be determined whether the corporation in question may be held to be a servant or agent of the Crown -- Tamlin v. Hannaford, (1949) 2 All ER 327. Of course, no difficulty arises where the statute which creates the corporation expressly states that it shall act on behalf of the Crown--cf. Glassgow Corpn.v. Central Land Board. 1956 SLT 41 "(1956) SC (HL) 1.
