The petitioner was made accused in Jandaha P.S. Case No.126 of 2009 under Section 376 of the Indian Penal Code. The petitioner claimed juvenility on the ground that the matriculation certificate, the marks-sheet, the admit card of matriculation and other documents disclosed that on the date of the occurrence, he was a juvenile in conflict with law. When such a prayer was made by the petitioner before the learned Judicial Magistrate 1st Class, Hajipur, the Court, instead of referring the matter to the Juvenile Justice Board for deciding about the juvenility, embarked upon such an enquiry himself and disbelieved the genuineness of the matriculation certificate on ground of different name in such certificate.
