11. Mr. Parag Tripathi, learned senior counsel for the NHAI has made the following submissions:

(i) On facts, it is evident that the Concessionaires want to keep their termination in abeyance endlessly, and these petitions are another means to that end. Since the Concessionaires have relied extensively on the three circulars to make their case, it would be pertinent to examine them in the appropriate light, that is, in the background of the facts of the present case.
