The petitioner is seeking a direction to respondents No.1 and 2 to release interest on the principal amount deposited by him from the date he deposited the amount till it was actually paid.
2. Respondent No.1 is stated to have advertised for the sale of plots/flats in the housing scheme Prasvnath Pride India at Rajiv Gandhi Technology Park, Chandigarh. The scheme had been jointly floated by respondents No.1 and 2 and sample model flats/villas had been constructed. The petitioner had deposited an amount of `32,57,750/- with the respondents on the basis of agreement dated 25.04.2008 against flat No.D-7-G03 which was allotted to him. He was also charged interest at the rate of 9% as per agreement, a copy of which is annexed as Annexure P-1. However, the project did not materialize and consequently, it was cancelled.
