4. Heard the arguments of Sri.A.K.Bhat, learned counsel for the petitioners on behalf of Sri.A.S.Girish, learned counsel on record and Sri.O.Mahesh, learned counsel for the Insurance Company.

5. It is contended by the learned counsel for the petitioners that undisputedly, the deceased was the cleaner of the mini lorry. There is coverage of policy NC: 2024:KHC:33833 under Ex.R2. Policy was issued subject to IMT.28. There is full coverage in respect of deceased, if the petitioners are able to explain that the driver of the mini lorry was holding valid and effective driving licence.

Adverting to the aspect of liability is concerned, there is no dispute as to the mini lorry was weighing gross weight of 9500 kgs., and the same has been specifically mentioned in the policy of insurance, which is made available before the Court. It is a package policy wherein Rs.25/- was collected as extra premium to cover the risk of driver/cleaner/coolies (exceeding 7 persons) subject to IMT 39A. The policy was issued subject to IMT endorsement numbers and memorandum - 7, 21 and 28. IMT.28 is relevant which clearly speaks of full coverage of the risk of the deceased.
