62. It is clear that the provision for no-confi- dence motion against the Chairperson was never re- pealed by any competent legislature as being inconsis- tent with any of the provisions of Part IX. On the other hand by subsequent statutory provisions the said pro- vision of no-confidence has been confirmed with some ancillary changes but the essence of the no-confidence provision was continued. This Court is clearly of the opinion that the provision of no-confidence is not in- consistent with Part IX of the Constitution.
