4. At the outset, Mr. T. Singhdev, the learned counsel appearing on behalf of respondent no.2/NMC invites attention of the Court to Annexure P-1 which is a letter written by the NMC to the Registrar of Pt. B.N. Sharma University of Health Sciences, Rohtak, which is an affiliating university of the Medical College in which petitioner is a student. Referring to the said letter he submits that since the impugned action has been taken on the basis of a report of CBI and further there is a reference made to the letter of Ministry of Health and Family Welfare ('MOHFW' for short), therefore the said Ministry as well as CBI are necessary parties.

She further submits that impugned letter from the NMC refers to CBI investigation, but NMC has failed to appreciate that the petitioner has been cited as one of the witnesses by CBI in its second supplementary chargesheet and there are no allegations or criminal charge whatsoever against the present petitioner.

8. In view of the above, issue notice. Mr. Suhail Khan, learned counsel appearing on behalf of respondent no.1 accepts notice. Likewise, Mr. T. Singhdev, accepts notice on behalf of respondent no.2/NMC. Mr. Sanjay Khanna, learned counsel appearing on behalf of respondent no.5/NTA also accepts notice.
