This Criminal Original Petition has been filed to quash the proceedings pending against the petitioner in S.T.C. No.65 of 2015, on the file of the Fast Track Court, Karaikudi.
2. This complaint in S.T.C. No.65 of 2015 was filed by the respondent/complainant as against the petitioner, for the offence punishable under Section 138 of the Negotiable Instruments Act.
3. According to the complainant, on 16.11.2014, the petitioner had borrowed a sum of Rs.4,30,000/-(Rupees Four Lakhs Thirty Thousand Only) and he has issued a cheque for the said sum, drawn in favour of Axis Bank, Karaikudi Branch, dated 01.03.2015. On presenting the cheque was returned for the reason of 'Account closed', by memo, dated 03.03.2015. After the same, the complainant took a statutory notice, dated 10.03.2015 and the same was returned on 18.03.2015, with an endorsement 'intimation served' 'unclaimed' to sender.
