The appellant filed an application under the Right to Information Act, 2005 (RTI Act) before the Central Public Information Officer (CPIO), National Thermal Power Corporation Ltd., New Delhi seeking copies of his absentee statement for the month of July, August, September and October as provided by the Field Engineering Services (FES) Department.

The appellant filed a second appeal before the Commission on the grounds that the CPIO did not provide the certified copies of the attendance sheet prepared by the FES Department for the period July 2016 to October 2016. The appellant requested the Commission to direct the CPIO to provide the information sought for.

Hearing:

3. The appellant Shri Anil Kumar Malviya and the respondent Shri S. Nandan, Asstt. General Manager, National Thermal Power Corporation Ltd., Lodhi Road, New Delhi were present in person. The respondent Ms. N. Shome, Senior Manager (HR), National Thermal Power Corporation Ltd., Unchhar attended the hearing through videoconferencing.

The appellant submitted that instead of providing the absentee statement for the months of July, August, September and October, the CPIO has provided the information for the months of August, September, November and December. He also stated that he wants the certified copies of the information sought for.

5. The respondent submitted that the appellant in his RTI application had not specified the year for which the absentee statement was required. Nonetheless, the absentee statement for the periods (i) 16.07.2016 to 15.08.2016, (ii) 16.08.2016 to 15.09.2016, (iii) 16.09.2016 to 15.10.2016 and (iv) 16.10.2016 to 15.11.2016 has been provided to the appellant. In this context, the respondent clarified that in NTPC Ltd., absentee statement is submitted for a period starting from 16th of the preceding month to 15th of current month and is known as absentee statement for the preceding month. Thus, the absentee statement for the period 16.07.2016 to 15.08.2016 is absentee statement for the month of July 2016. Further, in compliance with the FAA's order dated 29.03.2017, the absentee statement for the period 16.06.2016 to 15.07.2016 has also been provided to the appellant. Hence, the information sought for has been furnished to the appellant.

Decision:

6. The Commission, after hearing the submissions of both the parties and perusing the records, observes that the information sought for by the appellant has been provided by the respondent. The Commission notes that the appellant during hearing requested for certified copies of the information sought for. The Commission, therefore, directs the CPIO to provide certified copies of the appellant's absentee statement (prepared by FES) for the period from July to October, 2016 to him, within a period of two weeks from the date of receipt of a copy of this order under intimation to the Commission.
