It was further submitted that the applicant has given his representation dated NIL, which is still pending with the competent authority, and even without awaiting a decision on his representation, he has rushed to this Tribunal, and for this reason also, the OA was termed to be not maintainable, till his representation is decided. After giving detailed para-wise replies to the OA, it was reiterated that the work has been assigned to the applicant strictly as per the order dated 16.01.2008 issued in regard to the FPB, and that the stand of the respondents in this regard has been upheld by the Honble Delhi High Court in the matter of Harsh Vardhan Sharma vs. Union of India & Others (supra). It was, therefore, prayed that the OA is devoid of any merit, and is liable to be dismissed with costs.
