The learned Single Judge found in favour of the respondent, firstly, that the management proceeded with bias against her, only on account of the fact that she had made a claim in the aforesaid civil suit and soon after the disposal of the said suit, the respondent was sought to be proceeded against on false charges. The second aspect raised by the respondent before the learned Single Judge was that her termination was not in accordance with Section 8(2) of the Delhi School Education Act, which, inter alia, provides that "no employee of a recognised private school shall be dismissed, removed or reduced in rank nor shall his service be otherwise terminated except with the prior approval of the Director".
