On 18.2.2014, this court passed the following order:
"Learned counsel for the petitioner submitted that in terms of the instructions dated 20.12.2001, in case any post in the quota reserved for Balmikis/Mazhbis, Scheduled Caste Ex-servicemen and Scheduled Caste Sportsmen remains unfilled, upto 2% thereof shall be given to Vimukat Jatis/Bazigars, if any candidate in that category is found eligible. The total number of posts advertised were 25. The post reserved for Scheduled Caste Sportsmen was one. The claim of the petitioner is that as no candidate in Scheduled Caste (Sportsmen) was available, the post should be offered to him. A perusal of the aforesaid instructions shows that only upto 2% of the reserved category posts can be offered to Vimukat Jatis/Bazigars. Considering the fact that there was only one post of Scheduled Caste (Sportsmen), which remained unfilled, and the total number of posts in Scheduled Caste category were 10, in case reservation even upto 2% of the reserved category post is granted, still one post will not come to the share of Vimukat Jatis/Bazigars.
Learned counsel for the petitioner seeks time to refer to case law as to whether in such circumstances, the vacant post can be offered to the candidates of Vimukat Jatis/Bazigars."
Learned counsel for the petitioner submitted that he may be permitted to withdraw the present petition. Ordered accordingly.
