(53) As far as the other issues relating to failure of the appellant to rectify the structural defects and common facilities, in violation of Section 14 of the RERA Act, 2016 and the entitlement of compensation by the respondent in addition to the delay in possession as contended by the Respondent, the Appellant argued that in case of delay in giving possession of the flat, within prescribed period, the option was open to the allottee/respondent to claim refund of the deposited amount at the prescribed rate of interest and if despite the delay the allottee preferred for possession of the flat rather than refund of the deposited amount, the allottee's right to claim interest/compensation did not existed, especially when after execution of sale deed in favour of the allottee/respondent, the question of any structural defect does not arise.
