1. Heard counsel appearing on behalf of the parties.
2. This is a petition under Article 226 of the Constitution of India, wherein the writ petitioner is aggrieved by an order dated November 8, 2023 that has been passed ex parte against the petitioner.
3. Upon a perusal of the impugned order and considering the submissions made by the counsel appearing on behalf of the parties, it is clear that on this date the petitioner was not present and the matter was heard and decided ex parte.
4. In my view, the authority should not have passed the impugned order ex parte without granting another date to the petitioner.
5. In light of the same, the impugned order dated November 8, 2023 is quashed and set aside with a direction upon the authority concerned to grant another opportunity of hearing to the petitioner, and thereafter, pass a reasoned order on the same. The reasoned order should be communicated to the petitioner within a week from the date of passing of order.
6. With the above directions, the writ petition is allowed.
