The applicant places reliance on the office memorandum dated 10.10.2019 issued by the Government of India, Ministry of External Affairs, PSP Division which relates to the issuance of a passport to the applicant against whom the criminal cases are pending before the Court of law in India which notification vide paragraph 3 thereof reads to the effect:-
"3. It may be noted that applicants may be refused passports only on grounds mentioned under Section 6(2) of the Passports Act, 1967. Section 6(2)(f) of the Act states that the passport authority shall refuse to issue a passport or travel document to an applicant on the ground that proceeding in respect of an offence alleged to have been committed by the applicant are pending before a criminal court in India. GSR 570(E) dated 25.8.1993 was introduced to give relief -to such applicants against whom criminal proceedings are pending before any Court of law in India but who may need to travel abroad for some urgent business. Provided that the total life of a diplomatic or an official passport shall be ten years from the date of its issue. (7) [* * *]."

Section 6 of the Passports Act, 1967 reads as under:-

"6. Refusal of passports, travel documents, etc.--(1) Subject to the other provisions of this Act, the passport authority shall refuse to make an endorsement for visiting any foreign country under clause (b) or clause (c) of sub- section (2) of Section 5 on any one or more of the following grounds, and on no other ground, namely:--
(d) that in the opinion of the Central Government the presence of the applicant in such country is not in the public interest.
(2) Subject to the other provisions of this Act, the passport authority shall refuse to issue a passport or travel document for visiting any foreign country under clause (c) of sub-section (2) of Section 5 on any one or more of the following grounds, and on no other ground, namely:--
