h. It is also claimed that the project suffered from significant delay
and structural defects, and despite repeated reminders, neither the
contractor nor HPL addressed the shortcomings. It is submitted
that in such circumstances, any claim for escalation, interest, or
incentive lacks merit and is contrary to contractual stipulations.
i. The award of interest at 12% and 18% per annum, and costs
of ₹25 lakhs, is stated to be arbitrary and disproportionate,
particularly in view of the absence of contractual privity and lack
of sanction for excess work. The Petitioner/College asserts that no
justification was provided by the Tribunal for the quantum of
costs awarded.
