33. On account of there being no move by the plaintiffs to pay the balance of the agreed sale consideration within the time stipulated, agreement dated 01.01.2006 also stood cancelled between the parties. P1, vide hand written affidavit on stamp paper dated 29.04.2006, authorized his father and brother to cancel sale dated 01.01.2006 and adjusted the advance of Rs.50,00,000/- against the subsequent agreement to be entered into between the parties.
