Counter affidavit filed in Court today on behalf of respondent no. 1 is taken on record.

The petitioner was doing Pre-Ph.D. course in Physics from Indian Institute of Technology, Roorkee, in which he had to take certain amount of minimum credits, which the petitioner has failed to procure. According to the petitioner, however, these credits have already there as per the old Regulations and there is also a recommendation in his favour by the Student Research Committee, but the Department is not accepting that. Hence, the petitioner was constrained to file the present writ petition.

Without going into the merits of the case, writ petition stands disposed of with the direction and a request to the Director, Indian Institute of Technology, Roorkee, District Haridwar to look into the matter at his level, considering that what is at stake is the career of the petitioner, who is seeking Ph.D. from this premier institute, and in case there is any scope of the petitioner being enrolled in the Ph.D. as per law, let the same be considered.

6. Let certified copy of this order be issued within twenty-four hours on payment of usual charges.
