And further in so far as determination of the scale of fees is concerned, it has been found by the Apex court that providing better amenities to students in the form of competent teaching faculty and other infrastructure, costs money. And hence it should be left to the institution, which does not seek any aid from the State, to determine the scale of fee that it can charge from the students. (See: Paragraph 56 of TMA Pai ) "To put it differently, in the establishment of an educational institution, the object should not be to make a profit, inasmuch as education is essentially charitable in nature. There can, however, be a reasonable revenue surplus, which may be generated by the educational institution for the purpose of development of education and expansion of the institution." IV "7.5.5 In the event of withdrawal of the declaration of 'deemed to be university' status or dissolution of the Society or the Trust of the institution deemed to be university, the Corpus Fund shall stand forfeited to the Commission for meeting the liabilities, if any."
