4. That after scrutiny of the case file the counsel for the appellant suggested him to file the present appeal and asked him to procure some more documents from the record of the said complaint case. That as the said impugned order was passed against the complainant/appellant and to file the present appeal some more documents were required which were filed before the Ld. Consumer Forum, hence, they applied for the same and it took some time in preparation of the certified copies and the certified copies of the same were supplied on 15.12.2022. The appellant is still arranging for the funds to file the present appeal.
12. Reverting to the material available before us, we find that the impugned order was passed on 30.08.2022 and the period of limitation starts from the date of order which had expired on 29.09.2022. However, the Appellant has failed to file the Appeal within the stipulated time and the only reason stated by the Appellant is that the copy of the impugned order was not received by them and in the month of November, 2022, applicant contacted his counsel and on enquiry from the learned Consumer Forum and they came to know about the said order. It has also been averred that time was consumed in procurement of documents required for filing the appeal. Thereafter, appeal was prepared.
