The brief background of fact which has given rise to the present petition is that petitioner no. 1 was founded in the year 1975 and came to be incorporated in the year 1981 in Washington State, USA, having business interests in several products and services range including, Software, computer services, devices and solutions. Further petitioner no. 1 also develops, manufactures, licenses, supports and sells computer software and deals with in consumer electronics, handheld devices, personal computers as well as services and since about three decades is well recognized in the field. Petitioner no. 2 - original defendant no. 2 is a wholly-owned subsidiary of petitioner no. 1, which came to be incorporated in the year 1988 under the provisions of the Companies Act, 1956.
