They have been appointed prior to 2009 i.e. prior to Right of Children to Free and Compulsory Education Act, 2009 came into force. In view of the Judgment in Anjuman Ishaat-e-Taleem Trust vs. State of Maharashtra 7 Ors., 2025 SCC OnLine SC 1912 , it is mandatory for every teacher to qualify T.E.T. or C.T.E.T. KHUNTE 912-wp2524.26.odt 2/2 Examination. Accordingly, all the petitioners were appeared in the C.T.E.T. Examination in the month of February, 2026.
5. In view of the notice dated 12/03/2026, issued by the Director of Central Teacher Eligibility Test Unit, the scanned images of OMR Answer Sheet of the candidates and Answer Keys are uploaded on the website, so as to enable the candidate, if he is having any objection or if there is any mistake on the part of the Board.
6. The learned counsel for the petitioners submitted that in Writ Petition No. 2785 of 2026 (Javid Khan Salimuddin Khan & Ors. vs. The State of Maharashtra & Ors.) dated 13/03/2026, in similar facts, Aurangabad Bench directed the respondent-Zilla Parishad not to finalize the list of promotion till next date.
7. In the present matter, from the OMR Answer Sheet, it is contention of the petitioners that they have certain that they would qualify the Examination of C.T.E.T as the OMR Answer Sheets are published by the Board and the result of the petitioners is expected to be published within 15 days.
8. In our considered opinion, a prima facie case is made out to grant interim relief. As such, we direct the respondents not to effect any promotion till the result of C.T.E.T. Examination of the petitioners.
9. List the matter on 24.04.2026..
