Therefore, the analysis of the entire case laws on the subject as well as the term used in order 6 rule 17 of the Code of Civil Procedure shows that it is ultimately to decide and determine the real questions in controversy between the parties, the amendment has to be used, which means that the amendment need not be denied only on the technical ground, for, such denial would only lead to multiplicity of proceedings, which is uncalled for, especially in the present era of docket explosion.
