MA No. 205/2025 has been filed by the applicants seeking leave to move the O.A jointly under Rule 4(5)(a) of the CAT Procedure Rules 1987 as their grievances are common and seeking similar relief. After hearing, M.A is allowed.
2. The applicants are the employees working in the various categories in the office of Subsidiary Intelligence Bureau, Kohima, Nagaland. They claimed that they are entitled for the benefits of B/Y Class cities of HRA based on various judicial pronouncements of this Tribunal as confirmed by the Hon'ble High Court and later by the Hon'ble Supreme Court. Accordingly, the applicants submitted request before the competent authority which came to be dismissed by Annexure A-1 order. The premise of which Annexure A-1 O.A. 314/2025 with MA/205/2025 NENGDEILHE Digitally signed by NENGDEILHEN N SINGSIT SINGSIT 29 order was passed, is that the benefits of HRA in B/Y Class of employees is based on various decisions and the decisions apply only to the parties therein. This is reiterated in Annexure A-1, whereby the reliefs sought by the applicants were declined. Similar stand is taken in the OM issued by the Additional Dy. Director Kohima to all the outpost branches of SIB Headquarters.
4. Notice has been given to the CGSC.

Learned counsel for the applicant invited our attention to the various decisions passed by this Tribunal on identical cases specifically latest one being the order of this Tribunal in O.A 342/2023 by the Guwahati Bench of this Tribunal. The order is produced as Annexure A-2. The Tribunal was concerned with identical claim of HRA at B/Y Class cities rates of the basic pay alongwith the consequential benefits including arrears, monthly benefits as due and admissible to individual applicant. This Tribunal took note of the fact that similar orders have been passed in O.A 230/2004 and O.A. 314/2025 with MA/205/2025 NENGDEILHE Digitally signed by NENGDEILHEN N SINGSIT SINGSIT 30 148/2011 which was upheld by the Hon'ble Gauhati High Court and confirmed by the Hon'ble Apex Court. If the law is laid down by this Tribunal in a lis between the parties, all the persons who are similarly situated are entitled to get the benefits and the judgment/order cannot be in personem, but in rem.

Having considered this, we are inclined to dispose of this Original Application at the threshold directing the competent authority amongst the respondents to take up and consider the case of the applicants and after ascertaining that the facts and circumstances available therein are similar to the applicants in Annexure A-2 order as well as other orders referred to by this Tribunal, in O.A 230/2004 and O,.A 148/2011 and similar orders and pass appropriate orders in accordance with law. If the applicants are found to be similarly situated, they shall be entitled to the benefits of HRA at the rate applicable at present. The decision shall be passed as expeditiously as possible, at any O.A. 314/2025 with MA/205/2025 NENGDEILHE Digitally signed by NENGDEILHEN N SINGSIT SINGSIT 31 rate within a period of 2 months from the date of receipt of a copy of this order. All consequential benefits including the arrears shall be paid within a period of one month thereafter failing which it will carry six percent interest.
