17. It is contended in the said revision that the direction to pay compensation under Section 357(3) Cr.P.C. is without any inquiry or assessment of the Petitioner's capacity to pay, and passed without affording any opportunity of hearing or written submission on quantum.
18. It is further stated that the compensation amount of Rs. 61,47,800/- appears to have been calculated with reference to the loan and interest liability borne by the informant, and not necessarily correlated with any criminal liability proven against the Petitioner. The Appellate Court has also directed that the interest shall be computed from the date of loan disbursed by Punjab National Bank and further ordered for recovery in terms of Section 431 IPC read with Section 421 Cr.P.C., effectively converting a criminal conviction into an execution of a civil recovery.
