(6) Whether the impugned judgment is sustainable in Law in the
absence of any finding on the vital question that the fact finding inquiry
for the lost documents i.e. the AD cards is still pending and the trial Court
in its order dated 06.12.2007 recorded that the said inquiry is of vital
importance for the disposal of the suit?
(7) Whether the testimony of a sole witness (PW-1), in the absence of
any authority/attorney of the Plaintiffs in his favour, can be treated as that
of a recognized agent under Order 3 Rule 1 & 2 CPC, competent to
appear and dispose on the behalf of the Plaintiffs?
