Rules, which read as under:-
"CHAPTER VII
5. Replication.-The replication, if any, shall be
filed within 30 days of receipt of the written ... prevented by sufficient cause for exceptional
and unavoidable reasons in filing the replication
within 30 days, it may extend the time for filing
the same
been
disconnected by the plaintiff No.2.
5. The plaintiffs filed a Replication on 26.09.2017, producing
therewith an additional document.
6. Thereafter, issues were framed ... documents
which came into being only post the filing of the Replication, leave
alone the suit, and therefore, the embargo as contained in Order
beyond the maximum permitted
period of 45 days for filing of the replication.
2. The learned counsel for the defendant no.1, placing reliance ... have the power to
condone the delay in filing of the replication beyond 45 days of the
service of the written statement on the plaintiff
defendant praying for delay of
225 days in filing of the replication to the counter-claim to be condoned.
2. For the reasons stated ... application, the delay is condoned and
the Replication is taken on record, subject to payment of costs of
Rs.50,000/- (Rupees Fifty Thousand only

friendly assistance received from the plaintiff on an immediate basis.
Replication to the Written Statement of the Defendant
47. The plaintiff in replication ... loan was
given in May 2021.
48. The plaintiff in replication asserts that the defendant
categorically admits to having taken the entire loaned amount
with the defendants
having filed their written statements, while the plaintiff filed
replications to the written statements filed by the defendant ... recorded that the plaintiff does not wish to
file the replication to the written statements of the defendant nos.7 and
8.
15. The plaintiff
spite of opportunity granted, the plaintiff failed to file its
replication and the original documents. This Court, therefore, vide its
order dated 14.09.2010, while framing ... suit,
closed the right of the plaintiff to file the replication and the original
documents:-

this application, the plaintiff prays for extension of time to file the
replication.
2. By the order of this Court dated 21.07.2022, the application filed ... receipt of the written statement(s) of the
defendants to file the replication. The same expired on 27.09.2022.
