party No.1 rejected the cheque on the ground that cheque was
outdated despite the fact that cheque reached in the office ... party No.1 on dated
18.04.2016 rejected the cheque on the ground that cheque
was outdated. There is recital in affidavit that complainant
could
time of giving cheque, defendant No. 1 made request to the plaintiff to
present the said cheque after one month and thereafter again after ... cheque as he would make the entire payment in cash but
plaintiff presented the said cheque the same was returned with the remarks

presentation. That however, the said cheque got dishonored on its presentation with the
endorsement 'Funds Insufficient' vide cheque ... when the plaintiff again presented the cheque,
the cheque was returned with the reasons "instrument outdated/stale". That the plaintiff
sent a legal
question was dishonoured with
endorsement that the instrument was outdated. He submits that
admittedly the cheque was presented for encashment after its validity
period
inadvertence of the learned counsel for the applicant
insurance company, the cheque issued to the learned counsel,
for being deposited against the award under Section ... could not be deposited in time, and
now, the cheque has become outdated and has been returned
to the insurance company for issuance of fresh

This cheque was prepared in the name of SUNITA TOTLA. The banker did not
accept the said cheque as correct name ... original cheque has not been received by you, then what is
the alternative? As it is, cheque has become useless and
outdated.

complainant, he testified that cheque is considered outdated on the basis of
the date mentioned on the same and not on the basis
Vinod Giri in discharge of
his part liability had issued a cheque bearing no. 286145 dated ... reason 'instrument outdated'. It is further stated by the
plaintiff that the validity of the cheque is three months from the date
payment of
the said Bill No. 156, the defendant issued a cheque bearing no.
000134 for Rs.11,000/- dated 07.10.2016 which was duly encashed ... vide memo dated 01.12.2016 and
cheque No. 969831 dated 08.08.2016 was dishonoured with
remarks ''Instrument outdated' vide memo dated 01.12.2016.
