party No.1 rejected the cheque on the ground that cheque was
outdated despite the fact that cheque reached in the office ... party No.1 on dated

was outdated. There is recital in affidavit that complainant
could
time of giving cheque, defendant No. 1 made request to the plaintiff to
present the said cheque after one month and thereafter again after ... cheque as he would make the entire payment in cash but
plaintiff presented the said cheque the same was returned with the remarks

admittedly the cheque was presented for encashment after its validity

now, the cheque has become outdated and has been returned
to the insurance company for issuance of fresh

accept the said cheque as correct name ... original cheque has not been received by you, then what is
the alternative? As it is, cheque has become useless and
outdated.

payment of
the said Bill No. 156, the defendant issued a cheque bearing no.
000134 for Rs.11,000/- dated 07.10.2016 which was duly encashed ... vide memo dated 01.12.2016 and
cheque No. 969831 dated 08.08.2016 was dishonoured with
remarks ''Instrument outdated' vide memo dated 01.12.2016.
