deposit the
cheque bearing no.856744 in his bank account to honor the cheque
and accordingly the plaintiff deposited the aforesaid cheque on
10.10.2022 which ... plaintiff contacted the defendant regarding the fate of the above said
outdated cheque to which the defendant asked the plaintiff to deposit
another cheque bearing
complainant on 04.12.2018, wherein the cheque return memo was
enclosed with endorsement "cheque/instrument outdated". On inquiry

bank witness clearly establishes that the cheque reached the drawee
bank on 15.09.2014. Thus, the cheque was presented within the statutory validity
period ... cheque was not dishonoured on the ground of being stale. The
return memo does not record "stale cheque" or "outdated instrument
cheque bearing No.748766 for sum of
Rs.4,00,000/-, the cheque bearing No.748769 for sum of
Rs.3,00,000/-, the cheque ... cheque at Ex.P1
to Ex.P.5 presented by the complainant were dishonored on
27.10.2022 on the ground of "OUTDATED
favour of the plaintiff. The said cheque was dishonored by
its banker with an endorsement "Instrument outdated/stale".
The plaintiff being
same series were already exhausted by 2019 itself and new
cheque-book was issued in favour of the accused thereafter.
20.2 To counter the said ... means to verify that a new cheque-book has been issued to the
accused and some outdated cheques are being given by him. The

respondent, on 25.06.2016 defendant issued a
cheque bearing no. 000001 dated 25.06.2016 for an amount of Rs.

cheque for encashment through his banker, State Bank of India. However,
the cheque was returned dishonoured with the remarks "Outdated/Stale
Original cheque bearing No. 321742 dated
25.09.2013 for ₹3,00,000/-.
