Vijay deposed that on 22.04.2010
accused Nepal Singh Rana whose plot was having common wall with the
plot in question came alongwith 25-30 persons
wrongly shown in the site plan that
the plot in the South direction of the suit Plot is in the name of the Sh.

khasra no.360 and the common passage is on this plot only. He further
deposed that the land had not been

plot owners/builders by accepting illegal gratification per floor

developed their industrial plots have made sufficient arrangement

property, the plaintiff constructed a boundary wall on the
plot & a temporary ... also
constructed for common use of Sewadar of the Gurudwara.
After constructing boundary wall on the gate of the plot, a
board of Gurudwara
caused injury of above nature.

injuries.
FINDINGS:
23. In the present case, both ... about 09 pm at plot no. 832, Village Mundka,
Delhi in furtherance of their common intention voluntary caused injuries to
Sanjay and Sh Himanshu with
owners/ occupiers of flats in the multistorey building built
on Plot bearing no. 121-123, New Manglapuri, Mandi Road, New Delhi. It is
stated that ... Road till the
covered parking area at the ground floor; and (e) common roof/terrace being
used for providing water supply, rain water drainage system

Mendiratta, Anshu Mendiratta and Neeru Arora in furtherance of
their common intention being the owners of above stated property
were carrying out excavation ... furtherance of their common intention damaged the wall of the
adjoining building by excavating the basement in their plot and
thereby they all committed
allotment of plot of land and neither the promised plot of
land were allotted nor amount paid towards allotment of plot of land
were refunded ... amount paid towards booking of the plot of land, failing to
appreciate that there was a common sense, natural and truthful version by
the complainant
