alleged non-
payment of license fee by Respondent No.2, proxy litigation by the
landlords against the Excise Department cannot be entertained.
5. The remedies
learned counsel submits that the petitioner is conducting proxy
litigation on behalf of the judgement debtor/ respondent no.3, who has
CM(M) 2567/2024
privity with
the Plaintiff, whose case has been handled as a "proxy" by Sh. Jetha Nand
Saluja. There are various cases under Section ... Defendants sought Leave to Defend, claiming
that the pleas of fraud, proxy litigation, lack of territorial jurisdiction and the
bar of limitation, raised several
observation in
paragraph 28 of the impugned award relating to proxy litigation on behalf
of advocates of claimant, as wife of deceased
financially
constraints.
6. It is further submitted that this is proxy litigation supported by some
individuals, who have joined through VC even today, though they
submits that this is
nothing but a proxy litigation propped up by Mr. Sanjeev Malik, who
wishes to deprive the widow
Respondent No.4 submits that this entire litigation is a proxy litigation by
the earlier contractor, Jai Balaji Security Services, who had engaged the
Petitioners
signed by the
claimed workman and it is, in fact, proxy litigation by the persons, named as
Authorized Representative in this petition.
