liability" but it only excludes right to claim compensation under Section 163A. In other words, if a compensation is claimed under "no fault ... then either it can be an application under Sections 140 or 163A and not both. This is what has also been clarified in The Oriental
judge
bench of this Court understood the scope
of Section 163A of the Act to be enabling
an Insurer to raise the defence ... section (4) of
Section 140 of the Act in Section 163A of
the Act. Such absence has been understood
by the Bench
