and the provisions of Section 181 (4) Cr.P.C. had not been considered,

2009 (1) RCR (Crl.) 394 has observed that according to Section 181 (4)
Cr.P.C. the dowry articles are required
relevant to reproduce Sub Section (4) of Section
181 of the Code of Criminal Procedure, which reads thus:
"181. Place of trial in case ... torture for demand of dowry were raised. Section
181(4) of the Code of Criminal Procedure confers jurisdiction on
the Court where the goods entrusted
presently residing. According to Sub-section (4) of Section 181 of the Code of Criminal Procedure, offence of criminal misappropriation or of criminal breach ... 181(4) of the Code of Criminal Procedure, which lays down that any offence of criminal misappropriation or of criminal breach of trust

Clause 4 of Section 181 Cr.P.C., makes the thing
committed only under Section 498-A IPC but also
has been committed under Section 406 IPC.

From the perusal of Section 498-A IPC it is thus clear that
harassment or coercion to a woman ... prima facie, offence u/s 406 / 34 IPC is made out against the accused persons.
