petitioners have questioned the provisions inserted by way
of carving out section 18A of the Scheduled Castes and Scheduled
Tribes (Prevention of Atrocities ... Section 18 as
well as section 18A , are reproduced hereunder:

8. On close reading of Sections 18 and 18A of
the SC and ST Act it reads as under;

complainant has sustained grievous
injury and that there is bar under Section 18A of the Act in
granting anticipatory bail to the accused ... therefore, the learned Sessions Judge
has gone wrong in invoking Section 18A of the Act and declining
the benefit of anticipatory bail
