Department was prepared as per the provisions contained in Para 203.5
of IREM Vol.-I. The petitioners pleaded that the integrated seniority list ... further selection to the post of AOM (Group B) as per
Para 203.5 of IREM Vol.-I. The petitioners further disclosed that a total
respondent no.2 Shri Rohtas Kumar, by placing reliance on IREM
203.5 contained in Chapter II Section `A', which lays down the
"Rules ... position that they do
not fulfil the requisite minimum service conditions. Rule 203.5 is
relevant in this regard, and is reproduced hereinbelow:-
"203.5 Since
respondent no.2 Shri Raj Kumari, by placing reliance on IREM 203.5
contained in Chapter II Section `A', which lays down the "Rules ... position that they do not
fulfil the requisite minimum service conditions. Rule 203.5 is
relevant in this regard, and is reproduced hereinbelow:-
"203.5 Since
Indian Railway Establishment Manual lays down certain conditions under Rules 203.1 to 203.5. These rules, which underwent an amendment on 05.01.2006, are required ... vacancies and above - employees equal to three times the number of vacancies.
203.5. Since employees from the different streams will be eligible to appear
seniority list of the Danapur
Division. The Tribunal, referring to para 203.5 of Chapter II Section
'A' of IREM 1989 Vol. I, held ... other hand, the
employee contended that in terms of paragraph 203.5, the inter se
seniority for the purposes of promotion, has to be calculated upon
seniority list of the Danapur

seniority for the purposes of promotion, has to be calculated upon
different streams of the railways applying the provisions
of paras 203.4 and 203.5 of Indian Railway Establishment Manual, Volume
I, 1989 Edition in short ... scale of `2000-
3200. It was also his plea that para 203.5 of IREM-I did not prohibit
participation of Group 'C' employees
Vacancies and above - employees equal to
three times and number of vacancies.
203.5. Since employees from the different
streams will be eligible to appear ... considered."
The learned Tribunal allowed the Original Application,
relying upon Rule 203.5 to hold that the petitioner is eligible on
the basis
