7. So far as the offences punishable under Section 489A is concerned, I
found that there is no evidentiary materials collected
concurrently.
2. Initially the appellant faced indictment for the offences under Sections 489A and 302 I.P.C. After the commencement of the trial
other
witnesses, it does not amount to cruelty as defined
under Section 489A IPC. We find that the trial court
as will as the appellate
affirmed under Section 302 read with Section 34 IPC and
Section 489A read with Section 34 IPC. We also do not see any
reason
State v. Amit Bhardwaj and Ors., under Section 307 , 489A IPC & 3/4, Dowry Prohibition Act , whereby after hearing counsel for the revisionists under
quashing of FIR No. 382/2001 under Sections 489A / 406 / 34 of the Indian Penal Code registered at Police Station Gokul Puri
available or not on record to take cognizance under Section 4 , 489A IPC or any other provision of law.
7. However, the facts and circumstances
exercise of our
inherent power, we quash the proceeding initiated under
section 489A of the Indian Penal Code forming the
subject matter of Mojahidpur Isakchak
prosecution to prove beyond reasonable
doubt the ingredients of Section 489A IPC. Relevant portions from the
