reenacted as the Archaeological Monuments and Archaeological
Sites and Remains Act, 1958 (AMASR Act) and further
amended by the AMASR (Amendment & Validation ... required to exercised their powers under Sections 19(1) and
19 (2) AMASR Act to stop the construction of buildings within
the protected area. While
prescribed under the Ancient
Monuments and Archaeological Sites and Remains Act (AMASR
Act) would be required and that for such works "no prior
permission
Ancient Monuments & Archeological Sites and Remains Act,
1958 (AMASR Act) "the construction, maintenance and cleansing
drains and drainage works and of public latrines ... Temple,
Puri were permitted and which were not in terms of the AMASR
Act. Consequently, the Court proceeds on the basis of the
correctness
which contravenes the Ancient Monuments and
Archaeological Sites and Remains Act (AMASR Act) and which
are to be removed in due course.
