arbitrary and the same is passed without considering
and appreciating the facts and circumstances ... court has not considered the facts and
circumstances along-with the exhibits marked on both
the sides while passing the judgment.
(e) The trial court
lower court, the complainant himself examined
as P.W.1 and got marked Ex.P1 to 19. After conclusion of trial,
statement of accused ... appeared in
the prosecution evidence. Accused himself examined as DW1,

6. On hearing the parties, learned
